These Terms of Use ("Terms") govern your access to and use of digitalarge.com (the "Site"), operated by DigitaLarge Enterprises ("DigitaLarge", "we", "us", "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. The Site is informational
The Site provides general information about DigitaLarge and the work we do. Nothing on it is an offer, a quotation, a warranty, or professional advice, and nothing on it creates a contract between us. Any work we carry out for you is governed by a separate written agreement, and in the event of any conflict, that agreement prevails over these Terms.
2. Acceptable use
You agree not to:
- use the Site in any way that breaches applicable law or infringes anyone's rights;
- attempt to gain unauthorised access to the Site, its servers, or any connected system;
- probe, scan, or test the vulnerability of the Site without our written permission;
- interfere with the Site's operation or availability, or attempt to do so;
- introduce any virus, worm, or other malicious code, or use the Site to distribute unsolicited communications;
- scrape, harvest, mine, or systematically extract content from the Site, including for the purpose of training machine-learning models, without our written permission;
- copy or republish substantial parts of the Site, or present them as your own.
3. Intellectual property
The Site and its content — including its text, design, layout, graphics, and code — are owned by DigitaLarge or licensed to us, and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your own informational purposes. No other rights are granted.
Third-party names, logos, and trade marks shown on the Site remain the property of their respective owners. They appear solely to indicate software our work integrates with, and their presence does not imply any partnership with, sponsorship by, affiliation with, or endorsement from those companies.
4. Availability and accuracy
We aim to keep the Site available and its content accurate and current, but we do not guarantee either. The Site is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We may change, suspend, or withdraw any part of the Site at any time without notice.
5. Third-party links
The Site may link to third-party websites. We do not control them, do not endorse them, and are not responsible for their content, their practices, or any loss arising from your use of them. Visiting a linked site is at your own risk and subject to that site's own terms.
6. Limitation of liability
To the fullest extent permitted by law, DigitaLarge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profit, revenue, business, goodwill, data, or anticipated savings, arising out of or in connection with your use of, or inability to use, the Site — whether based in contract, tort (including negligence), statute, or otherwise, and whether or not we were advised of the possibility of such loss.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
7. Indemnity
You agree to indemnify and hold DigitaLarge harmless against any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
8. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
9. Changes to these Terms
We may revise these Terms from time to time. The date at the top of this page shows when they were last changed, and the version published here is the one that applies. Your continued use of the Site after a change constitutes acceptance of the revised Terms.
10. Severability and waiver
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision.
11. Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or with your use of the Site (including non-contractual disputes or claims), are governed by the laws of India. The courts at Sikar, Rajasthan shall have exclusive jurisdiction.
